These Terms of Service (“Terms”) govern your access to and use of our website, store, and related services (collectively, the “Services”). Our Services are hosted on Shopify. By using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
1. Access, Eligibility & Accounts
1.1 Eligibility. You represent that you are at least the age of majority in your place of residence. Our Services are intended for adults; any use by a minor requires the consent and supervision of a parent/guardian.
1.2 Account data. You may be asked to provide information (e.g., email, billing, shipping, payment details). You warrant that such information is accurate, current, and complete and that you have the right to provide it.
1.3 Security. You are responsible for safeguarding your account credentials and for all activity under your account. Do not share or transfer your account.
2. Products & Content
2.1 Accuracy. We strive to describe products accurately. Colors and appearance may vary by device settings.
2.2 Changes. Product descriptions, pricing, and availability may change at any time without notice. We may limit quantities and discontinue items at our discretion.
3. Orders, Contract Formation & Cancellations
3.1 Offer & acceptance. Your order is an offer to purchase. A contract forms only when we confirm acceptance (e.g., order confirmation email). We must receive and process payment before acceptance.
3.2 Non-acceptance. If we cannot accept or must cancel an order (e.g., genuine pricing/stock error), we will notify you and refund any amounts paid. If a material error affects your order after contract formation, we will offer you the choice to reconfirm at the correct details or cancel for a full refund.
3.3 Personal use. You confirm purchases are for personal/household use, not for resale or export.
3.4 Returns. Returns, exchanges, refunds, and the EU/UK 14-day right of withdrawal are governed by our Return & Refund Policy.
4. Prices, Taxes & Billing
4.1 Prices. Prices, promotions, and discounts may change without notice. The price in force at order time appears in your order confirmation. Prices typically exclude taxes, shipping, handling, customs, and import charges unless stated otherwise.
4.2 Promotions. Promotional terms (if any) govern in case of conflict with these Terms for that promotion.
4.3 Payment. You agree to provide valid payment details and authorize charges for your order total and applicable taxes/fees. You warrant you are authorized to use the payment method provided.
5. Shipping, Delivery & Risk Transfer
5.1 Timelines. Delivery dates are estimates, not guarantees. Delays may occur due to carriers, customs, or events beyond our control.
5.2 Risk transfer (EU/UK consumers). For consumers in the EU/UK, the risk of loss passes only when you (or a person indicated by you) take physical possession of the goods. If you arrange delivery through a carrier not offered by us, risk passes when the goods are handed to that carrier.
5.3 Title. Title transfers upon full payment and delivery according to applicable law.
6. Statutory Warranty for Consumers (EU/UK)
Nothing in these Terms limits your mandatory consumer rights. If a product lacks conformity, you are entitled to legal remedies (e.g., repair or replacement; or price reduction/refund in certain cases) for the statutory period after delivery, as provided by applicable law.
7. Intellectual Property
7.1 Ownership. The Services and their content (trademarks, text, images, graphics, video, audio, code, and design) are owned by Boys of Joy or its licensors and are protected by intellectual-property laws.
7.2 License. We grant you a limited, revocable, non-transferable, non-exclusive license to access and use the Services for personal, non-commercial purposes.
7.3 Restrictions. You may not copy, modify, create derivative works, distribute, publicly display, or exploit the Services/content without our prior written consent. All rights not expressly granted are reserved.
8. Optional Tools & Third-Party Links
8.1 Tools. We may provide access to third-party tools “as is” and “as available,” without warranties or endorsements. Your use is at your sole risk and subject to such third parties’ terms.
8.2 Links. The Services may link to third-party sites or include embedded features. We are not responsible for their content, policies, or transactions. Review third-party terms and privacy policies before engaging with them.
9. Relationship with Shopify
The Services are powered by Shopify. Sales are made directly with Boys of Joy. Shopify is not a party to your purchase and is not responsible for any sale or post-sale issue between you and Boys of Joy. You release Shopify and its affiliates from claims arising from your transactions with us. See also Section 10.
10. Privacy
Your personal information is handled according to our Privacy Policy ([Privacy Policy URL]). Because our Services are hosted by Shopify, certain personal information is also processed by Shopify to operate and improve the platform. For details on Shopify’s privacy practices, visit https://www.shopify.com/legal/privacy. By using the Services, you acknowledge both policies.
11. Feedback & Reviews
11.1 License. If you submit ideas, suggestions, reviews, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display such Feedback for any purpose.
11.2 Your promises. You represent that you own or control the rights to your Feedback; your Feedback is lawful and accurate; and you will not misrepresent your identity or any compensation received.
11.3 Moderation. We may (but are not obligated to) monitor, edit, or remove unlawful or objectionable content.
11.4 Reviews transparency (EU Omnibus). We do not post false reviews. Where we mark reviews as from verified purchasers, we take reasonable steps to verify that status.
12. Errors & Corrections
We may correct errors, inaccuracies, or omissions and update information (including after order submission). If a material error affects your order after contract formation, we will promptly offer you the choice to reconfirm at the correct details or cancel for a full refund.
13. Prohibited Uses
You may not use the Services: (a) for unlawful, malicious, or infringing purposes; (b) to violate laws or third-party rights; (c) to harass, defame, or harm others; (d) to transmit malware or malicious code; (e) to send spam or unsolicited promotions; (f) to scrape, crawl, or collect data unlawfully; (g) to interfere with security features; or (h) in any manner that restricts or inhibits others’ use of the Services. We may suspend or terminate access for violations.
14. Right of Withdrawal (EU/UK); Returns
If you are a consumer and your order is delivered in the EU/UK, you have a 14-day statutory right of withdrawal without giving a reason, subject to legal exceptions. Instructions, effects, timing, and your return-cost obligations are set out in our Return & Refund Policy.
15. Force Majeure
We are not liable for any delay or failure to perform due to events beyond our reasonable control, including but not limited to labor disputes, acts of God, epidemics/pandemics, war, terrorism, governmental actions, power or internet outages, supplier failures, or carrier/customs disruptions.
16. Disclaimer of Warranties (to the extent permitted by law)
Except as expressly stated by Boys of Joy and without prejudice to your statutory rights (including EU/UK legal warranty, Section 6), the Services and all products are provided “as is” and “as available.” We do not guarantee uninterrupted, timely, secure, or error-free operation.
17. Limitation of Liability (Germany/EU-compliant)
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence; intent or gross negligence; fraudulent misrepresentation; breach of guarantees expressly given; or liability under the German Product Liability Act.
For simple negligence, we are liable only for breach of essential contractual obligations (duties whose fulfillment enables proper performance and on which you regularly rely); in such cases our liability is limited to typical, foreseeable damages. Otherwise, liability for simple negligence is excluded. Mandatory consumer rights remain unaffected.
18. Indemnification (B2B or misuse scenarios)
To the extent permitted by law, you agree to indemnify and hold harmless Boys of Joy and our affiliates, officers, employees, and service providers from third-party claims and reasonable costs arising from your unlawful use of the Services or violations of these Terms.
19. Severability
If any provision is unlawful or unenforceable, it shall be enforced to the maximum extent permitted and the remainder of the Terms will remain in effect.
20. No Waiver; Entire Agreement
Failure to enforce a right is not a waiver. These Terms, together with policies referenced herein (e.g., Privacy Policy, Return & Refund Policy), constitute the entire agreement between you and us regarding the Services.
21. Assignment
You may not assign or transfer these Terms without our prior written consent; any attempt is void. We may assign or delegate these Terms without notice. For consumers, statutory rights remain unaffected.
22. Governing Law; Jurisdiction
These Terms are governed by the laws of Germany, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG).
For consumers resident in the EU/UK, the mandatory consumer protection laws of your country of residence also apply. You may bring claims in the courts of your domicile.
If you are a business, the exclusive place of jurisdiction is Berlin, Germany.
23. Consumer Dispute Resolution / EU ODR
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

24. Changes to These Terms
You can review the current Terms at any time on this page. We may update these Terms by posting a revised version with the effective date above and, where required by law, by providing additional notice. Your continued use of the Services after changes become effective constitutes acceptance.
